CONSTRUCTION DEFECT
The failure of the building or any building components in violation of the building code or applicable standard in the industry or the failure to perform in the manner intended by the manufacturer or reasonably expected by the buyer, which proximately cases damage to the structure. The failure can be caused by the faulty design, materials and/or workmanship.

Injury caused by another to the body, mind, or emotions of a person which results in damages. An injured person is entitled to recover both Special Damages (medical bills, lost wages, repair or replacement of property, etc.) and General Damages (pain and suffering, loss of consortium, and emotional distress).
